1. Introduction

Welcome to HeyTranslate, a micro-SaaS product provided by Lorenzo Imperatrice. These Terms and Conditions ("Terms") govern your use of our service. By accessing or using HeyTranslate, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our service.

3. Service Description

HeyTranslate is a software as a service (SaaS) that automates the translation of JSON files through a command-line interface (CLI) tool. The service integrates with third-party translation technology provided by OpenAI and does not retain any translated data.

• Maximum File Size: 50,000 characters (post-minification).
• Plans and Limits:
  • Free Plan: Up to 150,000 characters per main file and translation in up to 2 languages.
  • Premium Plan: Up to 1,000,000 characters per main file and translation in up to 2 languages.

4. User Responsibilities

You agree to use HeyTranslate in accordance with its intended purpose. Prohibited activities include, but are not limited to:

• Creating multiple accounts to circumvent limitations or avoid subscription fees.
• Exploiting software bugs to bypass character or language limitations.
• Providing inaccurate or misleading information when creating or managing your account.

5. Account Management

• Account Creation: Users may create accounts via email/password or GitHub integration. Accounts must be verified through a confirmation link sent to the user’s email.
• Account Maintenance: Users may update their account email via the account management page, which will trigger a new confirmation email.
• Age Restriction: While there are no formal age restrictions, the service is intended for users aged 18 and over.

6. Payment and Subscription

• Subscription Plans: HeyTranslate offers a Free Plan and a Premium Plan priced at 7.99€ per month.
• Billing: Payments are processed through Stripe. Failure to make timely payments may result in account suspension or termination.
• Refund Policy: All payments are non-refundable.

7. Intellectual Property

• Ownership: All intellectual property rights, including but not limited to copyrights, trademarks, and patents, related to HeyTranslate are owned by Lorenzo Imperatrice. This includes the software, logo, and name.
• No User-Generated Content Policies: HeyTranslate does not have specific policies regarding user-generated content.

8. Privacy and Data Security

Data is used solely to perform the service. Translations are not saved on HeyTranslate servers. JSON files are passed to OpenAI services for translation, and data retention is governed by OpenAI’s data retention policies. Users may request data deletion through the support form.

9. Service Availability

While HeyTranslate aims to provide continuous access to the service, we cannot guarantee uninterrupted or error-free service. The service may be modified or discontinued at any time without liability. No specific support service is provided.

10. Support

Support is not provided. Users may request data deletion through the support form.

11. Compliance with Laws

You are responsible for complying with all applicable laws and regulations related to your use of HeyTranslate.

12. Dispute Resolution

• Contact: Any disputes or complaints should be addressed to lorenzo.imperatrice[at]gmail.com . We will strive to resolve any issues in a fair and timely manner.
• Governing Law: These Terms and any disputes arising under or in connection with these Terms will be governed by and construed in accordance with the laws of Italy, specifically the Foro di Torino.

13. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms if such failure is due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, or technical failures.

14. Modifications and Termination

• Modifications: Lorenzo Imperatrice reserves the right to modify these Terms at any time. Significant changes will be communicated to users. Continued use of HeyTranslate following such modifications constitutes acceptance of the revised Terms.
• Termination: We reserve the right to terminate or suspend access to HeyTranslate at our sole discretion, without notice or liability, for any reason, including but not limited to a violation of these Terms.

15. Limitation of Liability

To the fullest extent permitted by law, Lorenzo Imperatrice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use HeyTranslate, (b) any unauthorized access to or use of our servers and/or any personal information stored therein, or (c) any errors or omissions in any content or for any other reason related to HeyTranslate.

16. Entire Agreement

These Terms constitute the entire agreement between you and Lorenzo Imperatrice regarding the use of HeyTranslate and supersede any prior agreements or understandings, whether written or oral, regarding the same.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

18. Waiver

Failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

By using HeyTranslate, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
